Overview

Operating a motor vehicle knowing your license is suspended or revoked. A criminal misdemeanor in New York. The word 'knowing' matters — if you were never notified of the suspension, it is a defense. Aggravated unlicensed operation (AUO) 1st, 2nd, 3rd carry increasingly serious criminal penalties.

$200–$500 (first, Unclassified Misdemeanor); higher for aggravated

  2. Obtain a copy of your DMV abstract to understand the basis for suspension
  3. Challenge whether you received proper notice of the suspension
  4. If notice was sent to old address: argue lack of knowledge
