Overview

Throwing, dropping, or depositing any litter, waste, or garbage on any public area — streets, sidewalks, parks, or subway. Also applies to improperly bagging trash or placing garbage outside of designated hours. NYPD and Sanitation officers may issue.

Fine Range

$50–$300 (civil); up to $450 (repeat)

Surcharge

$88 if criminal

How to Contest

  1. Contest at OATH (Office of Administrative Trials and Hearings) for civil violations
  2. Challenge whether the area was public or the act intentional
  3. Present evidence (photos, witnesses)

Common Defenses

  • Act was unintentional (item fell)
  • Area was private property
  • Waste was being transported lawfully
  • Issuing officer lacked direct observation
