Overview
Throwing, dropping, or depositing any litter, waste, or garbage on any public area — streets, sidewalks, parks, or subway. Also applies to improperly bagging trash or placing garbage outside of designated hours. NYPD and Sanitation officers may issue.
Fine Range
$50–$300 (civil); up to $450 (repeat)
Surcharge
$88 if criminal
How to Contest
- Contest at OATH (Office of Administrative Trials and Hearings) for civil violations
- Challenge whether the area was public or the act intentional
- Present evidence (photos, witnesses)
Common Defenses
- Act was unintentional (item fell)
- Area was private property
- Waste was being transported lawfully
- Issuing officer lacked direct observation
